SUBMISSION OF THIS FORM CONSTITUTES MY AGREEMENT TO THE FOLLOWING TERMS AND COMMITMENTS

APPLICATION. I acknowledge that Playmaker Systems, LLC (“PSLLC”) may for any reason, except for race, color, national origin, religion, sex, gender identity, sexual orientation, disability, age, marital status, family/parental status, or political beliefs, decline my request for a PLAYMAKER beta game test kit.

VOLUNTARY. I agree that my services to the PLAYMAKER beta Game Testing Program (“The Program”) are strictly voluntary and that I will receive no compensation from PSLLC. Further, I agree to inform participants to any PLAYMAKER beta Game Testing Session (“Test Session”) I organize that their participation is also voluntary.

RELATIONSHIP. I acknowledge that my relationship with PSLLC is independent and nothing in this agreement is intended to or should be construed to create a partnership, agency or employee relationship. Further, I agree to inform participants to any Test Session I organize that their participation should also not be should be construed to create a partnership, agency or employee relationship between them and me or them and PSLLC.

SUPPORT. I acknowledge that the principle purpose of The Program or any Test Session I organize is to help PSLLC access the PLAYMAKER beta Game (“The Game”) without supervision or direct support of PSLLC. This requirement not withstanding, I understand that I and Test Session participants are encouraged to access the resources of PSLLC’s website at www.playmakersystem.com for clarifications, perspective and insights.

QUESTIONNAIRE. I promise to complete and submit a questionnaire based on the outcomes and my assessments of the Test Session(s) I organize.

RELEASE. I acknowledge that PSLLC shall own all rights to any audio, video or written recordings I may provide PSLLC of any Test Session I may conduct. This shall include my responses to any questionnaire about my experience with The Game. Such content may be used by PSLLC for research, business development, marketing, and sales among other purposes, though not without its obligation to first obtain the permission of identifiable participants if PSLLC wishes to publish such content outside of the associates, partners and suppliers of its business network.

NONDISCLOSURE. Outside of the participant players I recruit to any Test Session(s) I will not reproduce or distribute any digital or physical materials supplied to me by PSLLC, to any participant of The Game, or other persons, firms, corporations or other entities without prior written authorization from PSLLC.

MATERIALS. If requested by PSLLC, I agree to promptly destroy or permanently delete any physical or digital materials, including documents, drawings, game cards, game instructions, models, sketches, designs and lists, furnished to me or Test Session(s) participants.

INVENTIONS. I acknowledge that any inventions that result from or in connection with The Game and Test Session(s) may be freely incorporated and/or modified by PSLLC without compensation to me or Test Session participants. “Inventions” means discoveries, developments, concepts, designs, ideas, know how, improvements, trade secrets and/or original works of authorship, whether patentable, copyrightable or otherwise legally protectable. Such inventions shall be considered the confidential information and intellectual property of PSLLC.

INDEMNIFICATION. I agree to indemnify PSLLC from any acts, events or consequences associated with any Test Session(s) I organize or of any claims made by Test Session participants in connection with The Game or, generally, The Program.

OTHER TERMS. I acknowledge that this agreement is intended to supplement, not supersede, any rights PSLLC may have with respect to the protection of its trade secrets or confidential or proprietary information. To that end, and to the extent that I may access the published content of PSLLC, I will comply with the Terms of Use at www.playmakersystems.com/terms-of-use/ as detailed in PSLLC’s website at www.playmakersystems.com.
